Terms of Service

Welcome to OmniFit Performance ("OmniFit," "we," "our," or "us"). OmniFit Performance is operated by OmniFit Performance LLC, a California limited liability company (formerly JJ4E LLC). By using our website, booking a session, or enrolling in any program, you agree to these Terms of Service. Please read them carefully.

1. Business Identity

OmniFit Performance LLC is registered in California (entity no. 202206310239). All payments, agreements, and communications are processed through OmniFit Performance LLC, San Diego County, California. OmniFit operates as an independent practice at Teqneeq Functional Health Center, 10772 Thornmint Rd, San Diego, CA 92127, and provides in-home training across North County San Diego. OmniFit is not a medical clinic and does not diagnose, treat, or assess medical conditions.

2. Services We Offer

We provide diagnostic-led personal training for busy professionals, including:

  • Performance Assessment (body composition, movement, and posture screening)

  • One-on-one personal training, in-studio at Teqneeq or in-home

  • Couples training

  • The Foundation (entry program) and The Program (continuing 4-week cycles)

  • The Executive Reset (virtual coaching)

  • Tune-Up sessions for program graduates

  • Nutrition and behavior-change coaching delivered within the programs above

Our programs are built on corrective-first strength training and evidence-based behavior-change methods. Specific inclusions, session frequency, and pricing are set out on our Rates page and in your signed client agreement.

3. Eligibility

You must be 18 years or older to use our services. By enrolling, you confirm that you are able to enter a binding agreement and that the information you provide, including health history, is true and accurate.

4. Client Agreements

Every program and session purchase is governed by a written client agreement (The Foundation Agreement, The Program Agreement, or the Sessions Agreement), signed before services begin. Those agreements are prepared to comply with the California Health Studio Services Act and California automatic-renewal law, and include your statutory cancellation rights. Where these Terms and your signed agreement differ, the signed agreement controls.

5. Payment Terms

Payments are processed securely through Stripe under OmniFit Performance LLC. Assessment bookings are confirmed through Calendly with a $30 refundable deposit; the Performance Assessment fee is credited in full toward your first program cycle if you enroll.

  • Appointment slots are confirmed only when payment is received. Unpaid slots remain open.

  • The Foundation is paid in full at enrollment.

  • The Program, The Executive Reset, and Tune-Up bill every 4 weeks, not monthly.

  • Teqneeq facility membership, where required for your tier, is billed separately by Teqneeq and is not an OmniFit charge.

  • Eligible clients may pay with HSA/FSA funds through our Truemed partnership, subject to Truemed's letter-of-medical-necessity process. OmniFit does not issue medical documentation.

Services may be paused or ended for late or missing payments.

6. Scheduling, Cancellations, and Refunds

Individual sessions

  • 24 hours' notice is required to cancel or reschedule. Sessions canceled with less than 24 hours' notice are forfeited.

  • Rescheduled sessions must be completed within the same 4-week cycle.

  • Sessions canceled by OmniFit are always credited back.

  • Single sessions expire 30 days from purchase; 5-session packs expire 8 weeks from purchase.

The Foundation

  • Paid upfront and non-refundable, except under the 30-Day Fit Guarantee below.

  • Two pause weeks are included across the course.

The Program and The Executive Reset

  • Up to six pause weeks per 12 months, with two weeks' notice, credited against your next cycle.

  • 30 days' written notice to cancel. Any remaining credit applies to the final cycle, and any balance beyond that is refunded.

30-Day Fit Guarantee

If OmniFit is not the right fit for you within your first 30 days on The Foundation, The Program, or The Executive Reset, tell us in writing and we will refund the unused portion of your enrollment. This is a fit and satisfaction policy. It is not a guarantee of any physical outcome or result.

7. Health Disclaimer

All information provided by OmniFit, on this website or in coaching, is for educational purposes only and is not medical advice. Consult your physician before beginning any exercise or nutrition program, particularly if you have injuries, medical conditions, or are pregnant. Body composition and movement screening are used to inform training decisions only.

8. Assumption of Risk and Release

By participating in any OmniFit assessment, session, or program, you agree that:

  • You voluntarily assume all risks associated with physical activity.

  • You release OmniFit Performance LLC, its owner, coaches, and affiliates from liability for injuries, losses, or damages arising from participation, to the fullest extent permitted by California law.

  • Results vary by individual and are not guaranteed.

A separate Liability Waiver and Release must be signed before services begin.

9. Client Conduct

OmniFit maintains a private, professional training environment. We may decline, suspend, or end services for conduct that is unsafe, disrespectful, or inconsistent with the code of conduct in your client agreement, or for repeated late cancellations or non-payment.

10. Intellectual Property

All website content, including text, video, images, program materials, and the OmniFit name and logo, is owned by OmniFit Performance LLC and protected by copyright and trademark law. You may not copy, distribute, or reproduce our materials without written permission.

11. Privacy

We collect and store personal and health-history information securely and never sell client data. See our Privacy Policy for full details.

12. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the courts of San Diego County, California.

13. Updates to These Terms

We may update these Terms at any time. The current version is always posted on this page. Continued use of our services after an update means you accept the revised Terms.
